I’m not too sure about the above tab for this section, it may be true to the album version (i haven’t listened to the album version very much), however, recently in live versions they drop to Dm key for the jam section. The chord progression you hear is Dm to A# and the scale Trey uses is a D natural minor scale most of the time. I like to play the Dm and A# like so:
